KLYVOREK Institute Privacy Statement

KLYVOREK Institute (“KLYVOREK,” “we,” “our,” or “us”) provides scenario-based training tools designed to help law enforcement professionals practice decision-making, documentation, articulation, and investigative reasoning.

We recognize that training information may involve professional performance, agency operations, and other sensitive information. This Privacy Statement explains the types of information we may collect through KLYVOREK Institute, how that information may be used, and the choices and responsibilities associated with its use.

1. Information We Collect

Depending on how KLYVOREK Institute is configured and used, we may collect:

Account Information. Information used to establish or administer an account, such as name, email address, agency or organization, role, and account credentials.

Training Activity. Information generated when a participant uses a training scenario, including scenarios accessed, responses submitted, decisions selected, written articulations, scenario progress, completion status, attempts, timestamps, and training feedback.

Training Analytics. Information derived from training activity, such as recurring areas for improvement, scenario performance, completion patterns, or other measures designed to support training and professional development.

Technical Information. Information necessary to operate and secure the service, such as IP address, browser type, device information, access logs, and security events.

We seek to collect only information reasonably necessary to provide, improve, administer, and secure KLYVOREK Institute.

2. Fictional Training Scenarios

Unless expressly identified otherwise, KLYVOREK Institute scenarios are fictional and are intended solely for training purposes.

Participants should not enter personally identifiable information, criminal justice information, protected investigative information, actual case information, medical information, Social Security numbers, driver’s license numbers, passwords, or other sensitive operational information into a training scenario unless their agency has expressly authorized such use and KLYVOREK has expressly approved the applicable environment for that information.

KLYVOREK Institute should not be used as a repository for actual investigative files or evidentiary material unless expressly authorized under a separate written agreement.

3. How We Use Information

We may use information collected through KLYVOREK Institute to:

  • Provide and administer training scenarios;

  • Maintain participant accounts and training progress;

  • Generate training feedback;

  • Provide authorized agency personnel with training information and analytics;

  • Identify opportunities to improve scenarios and instructional design;

  • Maintain, troubleshoot, and secure the platform;

  • Prevent misuse, unauthorized access, or fraudulent activity;

  • Comply with applicable legal obligations; and

  • Perform other activities described in an applicable agreement with the participant or participating organization.

KLYVOREK Institute is designed to support professional development and training. Platform-generated feedback or analytics should not, by themselves, be interpreted as a determination of legal compliance, employee fitness, professional competence, disciplinary responsibility, or suitability for any particular assignment.

4. Agency-Sponsored Accounts

When access to KLYVOREK Institute is provided through a law enforcement agency, academy, educational institution, employer, or other organization, that organization may have access to training information associated with its participants.

Depending on the organization’s configuration and agreement with KLYVOREK, authorized personnel may be able to view information such as scenario assignments, completion status, participant responses, written articulations, training feedback, and related analytics.

Participating organizations are responsible for determining how information available to them may be used in accordance with applicable law, employment agreements, collective bargaining obligations, agency policy, records-retention requirements, and other legal obligations.

Participants should understand their organization’s policies concerning training records before using an organization-sponsored account.

5. Training Records and Employment Decisions

KLYVOREK designs Institute analytics primarily to support training and professional development.

KLYVOREK does not independently determine whether a participant has complied with constitutional requirements, applicable law, agency policy, or professional standards based solely on scenario performance.

Organizations receiving training information are responsible for determining the appropriate use of that information.

Training records may be subject to an organization’s policies or legal obligations concerning personnel records, employment decisions, investigations, litigation, discovery, subpoenas, public-records requests, records retention, or other governmental requirements.

KLYVOREK cannot guarantee that information provided to or controlled by a participating organization will remain outside such processes.

6. Artificial Intelligence

Certain KLYVOREK Institute features may use artificial intelligence or automated systems to assist with functions such as scenario interaction, analysis, feedback, content generation, or evaluation of participant responses.

AI-generated outputs may be incomplete, inaccurate, or inappropriate for a particular factual or legal context.

AI-generated feedback is provided as a training aid and should not be treated as legal advice, an authoritative statement of law or policy, or an independent determination concerning a participant’s professional performance.

Where appropriate, human instructors, supervisors, or other qualified personnel should review training results within the context of applicable law, agency policy, and training objectives.

7. Legal and Policy Content

KLYVOREK may incorporate legal principles, training standards, or policy considerations into scenarios and educational materials.

Laws, court decisions, regulations, and agency policies change over time and vary by jurisdiction.

KLYVOREK Institute does not provide legal advice. Agencies and participants remain responsible for consulting current applicable law, agency policy, prosecutors, legal advisors, instructors, supervisors, or other appropriate authorities.

8. Sharing of Information

We may disclose information:

  • To the organization sponsoring or administering a participant’s account;

  • To service providers that assist us in operating, securing, hosting, or maintaining KLYVOREK Institute;

  • When required by law, subpoena, court order, or other valid legal process;

  • When reasonably necessary to protect the security, integrity, rights, or safety of KLYVOREK, our users, or others;

  • In connection with a merger, acquisition, financing, reorganization, or transfer of all or part of the business, subject to applicable legal requirements; or

  • With the participant’s or organization’s authorization.

KLYVOREK does not sell personal information to data brokers.

KLYVOREK does not use participant training performance to sell targeted advertising.

9. Data Retention

We retain information for only as long as reasonably necessary for the purposes described in this Privacy Statement, applicable agreements, security requirements, legitimate business needs, and legal obligations.

Retention periods may vary depending on the type of information, account configuration, contractual requirements, and whether an organization administers the account.

Where an agency or other organization controls or receives copies of training records, its own records-retention requirements may apply independently of KLYVOREK’s retention practices.

10. Data Security

KLYVOREK uses reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, loss, or misuse.

No online service, storage system, or method of electronic transmission can be guaranteed to be completely secure. Accordingly, KLYVOREK cannot guarantee absolute security.

Users are responsible for protecting their account credentials and promptly reporting suspected unauthorized access.

11. Participant Access and Corrections

Participants may be able to review certain account and training information through their account.

Requests to access, correct, or delete information may be subject to applicable law, contractual obligations, records-retention requirements, security considerations, and the rights or responsibilities of a sponsoring organization.

For organization-sponsored accounts, some requests may need to be directed to the sponsoring organization.

12. Cookies and Similar Technologies

KLYVOREK Institute may use cookies and similar technologies necessary to maintain sessions, authenticate users, remember preferences, understand platform performance, and protect the security of the service.

Where required by applicable law, additional consent or choices concerning non-essential cookies will be provided.

13. Third-Party Services

KLYVOREK Institute may use or integrate with third-party services for hosting, authentication, analytics, communications, artificial intelligence, or other operational functions.

Those providers may process information on KLYVOREK’s behalf subject to applicable contractual and security requirements.

Links to external websites or resources are governed by the privacy practices of those third parties.

14. Public Records, Discovery, and Legal Process

Because KLYVOREK Institute may be used by governmental entities, certain information may become subject to public records laws, litigation holds, discovery obligations, subpoenas, court orders, audits, investigations, or other legal processes.

Whether a particular training record is subject to disclosure depends on applicable law, jurisdiction, circumstances, and the entity controlling the record.

KLYVOREK does not represent that information created through the Institute is categorically exempt from disclosure.

15. Children’s Privacy

KLYVOREK Institute is intended for law enforcement professionals, trainees, instructors, and other authorized adult users. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Institute.

16. Changes to This Privacy Statement

We may update this Privacy Statement as KLYVOREK Institute, applicable laws, or our data practices evolve.

When material changes are made, we will update the “Last Updated” date and provide additional notice when required by applicable law or agreement.

KLYVOREK Institute provides an environment for deliberate practice. The appropriate agency and authorized professionals remain responsible for training standards, agency policy, legal interpretation, supervision, and personnel decisions.
